Terms of Service

1. Who we are

“CosmicAI Studio”, “we”, “us” refers to CosmicAI Studio, the operator of cosmicai.studio. We provide an AI-powered suite of creator tools — including video script and meme generation — built on top of third-party large language models, search, and content discovery providers.

2. Eligibility & account

You must be at least 18 years old and able to enter a binding contract to use the service. You’re responsible for keeping your account credentials secure and for everything that happens under your account. Notify us promptly at legal@cosmicai.studio if you suspect unauthorized access.

3. The service

CosmicAI Studio generates short-form video scripts, meme adaptations, and related creative artifacts based on a profile you provide and live signals (trending content, niche research). Output is generated by third-party AI models and cannot be guaranteed to be accurate, original, factual, or fit for any particular purpose.

We may add, modify, or remove features, including formats, models, and third-party integrations, at any time. We’ll provide reasonable notice for material changes that affect paid users.

4. Subscription & billing

Paid features are sold on a subscription basis. Fees, billing cadence, and included usage are described on our pricing page at the time of purchase. Subscriptions auto-renew until cancelled.

• Payment is processed by Stripe. We never store your full card details.
• Fees are non-refundable except where required by law. You may cancel at any time; access continues through the end of the current billing period.
• Taxes are your responsibility unless we’re legally required to collect them, in which case they’ll be added to your invoice.
• We may change pricing for future billing periods with at least 14 days’ notice to your account email.

5. AI-generated content

Outputs are produced by machine-learning models. They may be inaccurate, biased, derivative, or unintentionally similar to existing content. You are solely responsible for reviewing, editing, fact-checking, and clearing rights on any output before you publish, file, post, or otherwise rely on it.

Do not use outputs in contexts where errors could cause harm — including but not limited to medical, legal, financial, or safety decisions — without independent professional review.

6. Your content & intellectual property

Your inputs. You retain ownership of the business information, brand assets, and other content you submit. You grant us a limited, worldwide, non-exclusive license to use it solely to operate the service for you (including sending it to AI providers, storing it, and producing outputs).

Outputs. Subject to applicable model-provider terms (which may impose additional conditions on commercial reuse), you own the outputs we produce for you. You acknowledge that similar or identical outputs may be produced for other users, and that AI-generated works may have limited or no copyright protection in some jurisdictions.

Our IP. The platform, software, branding, and documentation are owned by us. Nothing in these terms grants you rights to our IP beyond your right to use the service.

7. Acceptable use

You agree not to:

• Use the service to create content that is illegal, defamatory, harassing, hateful, sexually explicit involving minors, or that infringes others’ rights.
• Impersonate any person or entity in a way intended to deceive or harm.
• Attempt to reverse-engineer, scrape, or build a competing service using our outputs or our APIs.
• Bypass rate limits, share API credentials, or misuse the service in a way that imposes unreasonable load on our infrastructure or third-party providers.
• Use the service to generate material that violates the terms of any underlying model provider (Anthropic, Google, etc.) or content source.

8. Third-party services

We rely on third-party providers to operate the service, including but not limited to: Clerk (authentication), Neon (database hosting), Vercel (application hosting and AI Gateway), Anthropic (Claude), Google (Gemini), Apify (content discovery), Tavily (web search), and Stripe (billing). Your use of the service is also subject to those providers’ terms.

9. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI outputs will meet your expectations.

10. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the service is capped at the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD $100.

11. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your inputs, your published outputs, or your violation of these terms or applicable law.

12. Termination

You may stop using the service at any time. We may suspend or terminate accounts that violate these terms, fail to pay, or pose risk to the service or other users. Sections that by their nature should survive termination (IP, disclaimers, liability, indemnity, governing law) will survive.

13. Changes to these terms

We may update these terms periodically. Material changes will be announced by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

14. Governing law & disputes

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Disputes will be resolved exclusively in the state or federal courts located in San Francisco County, California, and both parties consent to that jurisdiction.
